I'm pretty upset about this one too BB... What type of message does this send to those cowards who commit violent offenses against women...!?!?!? You'll get sent to prison for shoplifting, but slapping your girlfriend is fine.

And this sounds like a lot more than a slap...throttling her when she has your child her arms, and bashing her with a crash helmet....

If he had a previous record for assault then a few months behind bars should have been a no brainer....the courts here are a complete joke

"It was also revealed Simmons had pervious convictions for assault and grievous bodily harm dating back to 1995...Acting Magistrate Justin Williams considered sending him to prison. However, he sentenced Simmons to six months at Westgate, suspended for 12 months. "

An then you read a guy trying to get on the cruise ship was slapped with a $2k fine - brilliant !

Particularly as he could have been charged with burglary or housebreaking as a result of this incident. He also used an offensive weapon. The suspended sentence is used far too often in Bermuda, in my opinion. For those that don't know, in order for a suspended sentence to be imposed, the magistrate must first be satisfied that a custodial sentence is justified, and then decide that there are special circumstances warranting the suspension of that custodial sentence. Most magistrates and, indeed, judges misuse suspended sentences all the time, though. Where are the special circumstances here, for instance?

Perhaps this suspended sentence was all part of the "keeping the inmate numbers down" which was proudly broadcast in the paper the other day.  http://www.theroyalgazette.com/siftology.royalgazette/Article/article.jsp?sectionId=60&articleId=7d75ab730030004

Oh like the hotels are fuller than last year ??  Maybe because there are less of them now that Sonesta has closed - so the remaining ones might be at a higher capacity without there being any more people here.

The crime stats thing isn't unique to Bermuda - in the UK a number of years back I had my handbag stolen.  As I didn't see who took it - it was repoted as I had "lost" it - whatever !...same with other crimes too.  A relative had someone trying to break in to their house and because they didn't actually get in it was recorded as criminal damage rather than attempted burglary...funny that burglary figures were then reoprted to be on the decline....

The chap getting the suspended sentence is outrageous though - he needs to be made an example of to show that behaviour of that sort should not and will not be tolerated .

This is all too familiar.. seems Bermuda's going in ever-decreasing circles. To the pathetic crims that beat up women, a suspended sentence is much the same as getting off scot-free. It is not the first time we've commented on this issue - there was the man who broke a restraining order by again committing domestic violence. Suspended sentence. Dude runs over ex on moped, gets off and stomps on her face hard enough to leave a boot imprint, runs over her again... suspended sentence.

That's right folks... Bermuda is tough on crime and believes in the rights of women to be protected from violence.

NOT.

they break up cuz of previous violent acts...so there's a pattern.  Then in a jealous fit, he removes the AC, climbs into her home and then starts choking her with two hands, then to finish it off he hits her with his helmut and slams her head into a wall, WHILE she's holding their child.  He says that she's 'lucky' the child was there...so basically it would've been worse if the child was not there.  And they gave this guy a suspended sentence?Huh? Am i missing something?  what a joke.  So she must live in fear now, cuz the courts are pathetic...no wonder no one wants to come forward to be a witness...what's the point?

Hmm, no wonder the numbers jailed have dropped. Are they keeping out as many as possible to vote in an election? Nah, surely not.
