That must be seriously frustrating for the police, victims, jury etc. Is the public prosecution office performing so badly in Bermuda or is there something else at play here?

This is one o the things that the new DDP will be looking into. In the US the prosecutors office and the police work very closely together to build cases. This gives the police\investigators a "legal mind" with hands on involvement, as opposed to Bermuda where the police submit a completed file to the DPP, and all the DPP do is review it to see if there is sufficient evidence to go to trial.

This whole process needs to be looked at carefully and updated if needed.

If the police had been performing their job properly, he'd also be up on drug possession.

So the person (can't call him a man) in question has been found guilty. He is to be sentenced shortly.

An interesting exchange was the one between defence lawyer Peniston and the judge. From the RG:

the defendant's lawyer Llewellyn Peniston found himself in hot water with Mrs. Justice Simmons, having been reprimanded by her on numerous occasions during the case for the nature of his questioning. He, in turn, frequently complained of feeling "shackled" by the judge. She told him after the verdict: "I have found your conduct wanting throughout this trial and I wonder if you will apologise to the face of the court?"

Mr. Peniston replied: "I apologise to Your Ladyship...but when it appears that the bench (ie the judge) is talking down to me, I will respond in a like manner. I had the impression shackles were put on me. It was in response to the perception of that I behaved in that way. I think to avoid repetition, My Lady should be aware of my sensitivity."



OK, so, he doesn't plan on winning any cases before that judge any time soon, then?

He's not that smart, he's just an ass. Justice Simmons is a very pleasant and diligent judge and the RG reports show that he was a complete ass. To suggest to a judge that you wouldn't give full marks to them for their summing up? Holy ass, what a dick..................

Speaking as an attorney, I'm happy to confirm that he's a prick par excellence, and that unfortunate combination of stupidity and arrogance. Justice Simmons is a nice lady, and smart, too boot. I've appeared in court and chambers  before her many times and she has always been class personified. As for him? Euurgghh.

Who the hell does he think he is?  The judge is as you so aptly put sitting on the bench on high.  He's a little pipsqueak pretending to be a lawyer.  I'm glad of the outcome of this case.  It has renewed my faith in the jury system.  I hope they put his bad ass behind bars for a very long time.  He used to work for me, and believe me when I tell you, he is BAD NEWS. Angry

I know that the intent is to protect the victim, but perhaps if we have a register whereby the animals names are put on it a few years into their sentence we can protect both the victim's identity and the rest of the population.

Name and shame issue has been raised many times.  There are rapists, and child molesters out and among us, and except for those close to the cases, no-one knows who they are.  They could be living next door to your kids....scary isn't it?

It is very creepy. I used to work with that dirt bag ex-cop John White (may he burn in hell.) I actually invited him into my home once or twice. I know other former co-workers who did the same and even let him play with their kids. I saw him in the jail at Hamilton Police Station when he was arrested and just had to leave before I did something stupid.

I served on the jury that convicted that son of a bitch...  unanimously guilty... 162 years!  Too bad it wasn'r consecutive.  To hear those little boys testifying on the stand was heart breaking...  and his defense??...

IT NEVER HAPPENED!!!

Well that defense got him extra time... cuz Carlisle Greaves don't stand for no nonsense he threw the book at him for making those kids have to re-live that nightmare...
