Dwayne Caines obo Polize:  "But motorcyclists in the habit of weaving in and out of rush hour traffic are also being warned, as they, too, could find themselves before the courts.

He added: "During morning and evening rush hours, the indiscriminate behaviour of cyclists overtaking improperly is also cause for concern.

"People should expect the Police to be out there looking for them. Improper overtaking will not be treated lightly, so people should take heed..."

The ONLY way they can ticket someone for this would be under Due Care & from what I can remember of the Law, there is NO way to fairly evaluate Passing a slower/stopped vehicle.  This will be a totally 1-sided judgement on the Officer's behalf - not fair at all.

I dare the Police to attempt to ticket me from 'overtaking improperly'.  I already have my defense prepared, with references from other motorists and all.

Wookie,

I am not a big ticket fan myself...but I would point out that all tickets are the officers interpretation of the law (or as you may feel one sided), case law and the traffic code to establish if evidence of an offence has been committed.

If you or anyone doesn't think they committed the offence - they can challenge the ticket at a court case and present whatever evidence you may have or wish to raise as a defence.

Depending on the circumstances, time of day, traffic flow, manner and speed in which the overtake was done, traffic controls in place (yellow lines etc.) a person can certianly commit traffic offences when they create a 'third lane'.

Let us know how you make out if you get a ticket.... Wink....

Great blog post Wookie, but surely you can't be defending the guys on bikes weaving around, forcing other motorists to take evasive action or risk having their car (or bike) struck.

Where Caines misses the mark (again) is that it's just not rush hour traffic that dangerous overtaking occurs. It happens during the regular day as well as evening. And there seems to be no way to stop this dangerous activity unless the offenders themselves get their vehicles removed from them.

I just wish that somebody would take a stand in relation to illegal lights/sound systems. Oh, and at least bring up for debate the possiblity of banning active usage of cell phones while driving and riding.

Is that someting like the police car that overtook me on a corner on Sunday afternoon The Sergent who was driving was on his cell phone, and almost hit the bike coming the other way...

Yup - tests have proven without a doubt that driving whilst talking on the cell-phone is equivalent to a certain degree of drink-driving. With narrow roads, too many cars and trucks adding in the number of cycles it's way passed time to sort out the cell-phone rules.

Just love seeing bus drivers swishing around corners chit-chatting away. I sometimes want to climb on board and grab their phones and tell the person on the other line they are total jerk-offs causing a distraction that could end up killing someone very easily.

If I were an insurance company exec. I'd start demanding that anyone in an accident must give their cell-phone records up. If they were on the phone when the accident occured then no claims will be paid out. Make that a law for starters.

Piggie - you're right.  The only way I can officially make a mistake is to pass on a Yellow line.  Otherwise, it's up to the Police to make a sound judgement.  One hopes that my Business attire, lack of deafening exhaust & drab i.e. non-Painted/buffed/tricked jitla will lull them into complacency Smiley

Tryangle, simple answer: Certianly NOT!

Anyone who gets passed by me on De SilverGrey, can attest (somewhat anonymously!) that I take great pains to pass safely.
-  Wait until nothing is coming up the other lane (or another bike who moves over)
-  Give them ample time to see ME behind them
-  Pass slowly enough for them to see me doing so
-  Never dive across a bumper to get back into line (all about timing & seeing the road ahead)

Rasta....yah tawkin crep. I remember when we did'nt even have 'yellow lines'. Detz rite! It was nut until 1955 when they introduced the "Kisskadee" that 'yellow' came into affect. In fact....the Smiths and the Talbots got together and wrote a sahong habowt hit..........

"Yellow Line" up high on Bermuda rowdz.

Props to the rider of De SilverGrey (tm) and others who aren't in a hurry to send somebody to the hospital. Sad that this seems to be the minority of vehicle users here.

Piglet you may be in position to answer this best - are the officers on the streets restricted in what they can and cannot do regarding road users?

I'm thinkiing about, for example:
  • the person who while on their cell phone, cuts somebody off and forces them to brake hard to avoid collission
  • the person who nearly runs a pedestrian over on the zebra crossing
  • the person who rides their pedal cycle on the sidewalk
  • heck, the guys at an intersection with traffic lights, have their vehicle on or past the crosswalk area (technically, running the red light)

I was under the impression that it is illegal to pass within the left unless under certain conditions such as passing pedal bikes or vehicles turning right. I am passed constantly between my scooter and the yellow line usually there is only a 2 foot space. Doesn't a vehicle passing another vehicle need to pass in the right hand lane?
